No records are required to be maintained under 18 U.S.C. §§ 2257 or 2257A for any content published or distributed by Letterhead, a trading name of Morena Pixels, Inc.
Why
Sections 2257 and 2257A, and the regulations at 28 C.F.R. Part 75, impose age-verification record-keeping duties on producers of visual depictions of actual human beings engaged in actual or simulated sexually explicit conduct. They do not reach virtual representations — drawings, cartoons, paintings or computer-generated images that do not depict a real person.
Everything Letterhead produces falls outside that scope:
- The stories are written fiction. Text is not a visual depiction.
- The position postcards, stickers and other printed matter are illustrations of fictional characters, drawn in house. No real person is depicted, photographed or filmed.
- The unboxing videos show an envelope being opened. They contain no sexually explicit conduct and no identifiable performer.
Accordingly, Morena Pixels, Inc., trading as Letterhead, is not a producer as defined at 28 C.F.R. § 75.1(c) and has no § 2257 or § 2257A record-keeping obligation.
If that ever changes
Should Letterhead ever publish photography or video of actual human beings engaged in sexually explicit conduct, this page will be replaced with a full compliance statement naming the custodian of records and the address at which those records are held, and the records will be created and maintained before publication.
